Digg users get their old data back

The relaunch of social news?site Digg a month ago was accompanied with a slight controversy: what happened to the years of links and comments people had submitted on the old site? Turns out they didn't throw them away after all, and you can download yours right now.

All you need to do is go to the Digg Archive and put in the email or username you had back in the old days. You'll get an email right away with a download link, or you can use tools they provide to import your old links and comments using Pinboard or Kippt, two link-managing services.

It's easy enough, but most users won't find much use for a big file of years-old comments with no context. Still, it's a gesture of goodwill that many developers and power users will find handy ? and it's good to know that the team behind the new site didn't just throw the old one in the bin.

Note that this doesn't go back to the very early days, just the version of Digg that existed before this one. If you haven't been on the site in a couple years, there probably isn't much for you to download.

Q: Where did you stay while filming?
A: The cast stayed at the Parco dei Principi ($$$),near the far side of Villa Borghese. It was very fancy, but old-school, like seventies-style, which makes sense given Woody Allen. It was definitely built when you wanted to use as much chrome as you could get.

Q: In a city full of famous locations, did you have a favorite?
A: We shot a scene at night in Campo de? Fiori, a glorious square with a fountain. It was just magical.

Q: And the food?
A: Sometimes I would walk 40 minutes to Ciampini to have gelato for breakfast. It?s like eating butter with ice cream. And I?d never really had truffles before?? I ate a disgusting amount of them. I would order two pastas at dinner, which is why I?m a little chubby in the film.

Q: Did you take any side trips?
A: Florence. I?d never seen Michelangelo?s David, which made me cry. It?s so iconic that you don?t expect to have a reaction to it. But you see it and it?s so human. It completely floored me.

Q: Woody Allen seems to be working his way through Europe. Where would you like him to film next?
A: I?d love to see what he?d do in a movie about Berlin. That would produce great comedy. I watched Bananas again recently and I think he does well in places with less romance. Just imagine: To Berlin with Love from Woody Allen.

Could a cancer drug prevent learning disabilities in some kids?

ScienceDaily (Aug. 29, 2012) ? A drug originally developed to stop cancerous tumors may hold the potential to prevent abnormal brain cell growth and learning disabilities in some children, if they can be diagnosed early enough, a new animal study suggests.

The surprising finding sets the stage for more research on how anti-tumor medication might be used to protect the developing brains of young children with the genetic disease neurofibromatosis 1 -- and other diseases affecting the same cellular signaling pathway.

The findings, made in mice, are reported in the journal Cell by scientists at the University of Michigan Medical School and their colleagues. The results are also important to understanding the stem cells that become different brain cells.

Neurofibromatosis 1, or NF1, affects one in every 3,000 children, and causes benign tumors to grow throughout the body, large head size and other issues. Many children with NF1 also struggle with learning to read, write, do math and behave well.

This impact on brain function is considered the most common serious issue caused by NF1, and often appears before other symptoms, except for brown patches on the skin that are often mistaken for birthmarks. But while the tumors that erupt mostly later in life have been well-studied, NF1's effect on brain function isn't understood.

In the new paper, the team studied neural stem cells -- a kind of master cell that can become any type of neural tissue. In newborn mice with two copies of the genetic mutation that causes NF1, neural stem cells in a key area of the brain were far more likely to produce a kind of "helper" nerve cell called glia. They produced far fewer cells called neurons, which send and receive crucial signals in the brain and body.

The scientists then took aim at this abnormal cell growth by giving the mice an experimental drug that has already been used in clinical trials for advanced cancer. Called PD0325901, the drug blocks a specific action within cells called the MEK/ERK pathway. It's one of a class of drugs known as MEK inhibitors.

Mice with the NF1 mutation that got the drug from birth developed normally -- in stark contrast to mice with the same genetic mutations that didn't receive the drug. The untreated mice appeared normal at birth, but within a few days had become hunched and scruffy, with abnormal growth of their bodies and brain cells.

The new paper's senior author, Yuan Zhu, Ph.D., cautions that the particular drug in the trial may not be appropriate to give to children who have been diagnosed with NF1. But other MEK inhibitors are being developed against cancer.

"The important thing is that we have shown that by treating during this brief window of time early in life, when neural stem cells in a developing brain still have time to 'decide' what kind of cell to become, we can cause a lasting effect on neural development," he says. Zhu is an associate professor of internal medicine, in the Division of Molecular Medicine and Genetics, and in the Department of Cell & Developmental Biology, at the Medical School.

The scientists didn't study the drug's effect on the behavior or learning ability of the mice, nor their tendency to develop benign brain tumors that can occur in NF1. In order for any such drug-based intervention to work most effectively, he notes, it would have to be given soon after developmental delays or benign tumors are noted in an infant or toddler, and after a NF1 diagnosis is made.

About half of all people with NF1 inherited the mutated gene from a parent, while about half developed it spontaneously in the womb. The disease affects individual patients very differently -- one child born to a parent with mild NF1 can have a severe form of the disease, while their siblings can have mild or moderate symptoms.

Some people with NF1 have a "double hit" form of the disease, where both copies of the gene are mutated in certain body cells. The second mutation, the scientists say, likely occurs in a neural stem cell that goes on to produce unusual neural cells. These patients often have severe learning disabilities, and an enlarged corpus callosum -- a structure that connects the two halves of the brain and contains a large concentration of glia, the same cells that the mice in the new study had larger numbers of.

In addition to NF1, the researchers predict that their findings may have importance for patients with other genetic conditions that affect the same general cell-signaling pathway called RAS. Collectively called neuro-cardio-facial-cutaneous (NCFC) syndromes or ''RASopathies," they include Leopard syndrome, Noonan syndrome, Costello syndrome and Leguis syndrome -- all of which, like NF1, affect the brains, circulation system and the face or head.

The new research is based on several other discoveries made by current or former U-M faculty. The gene for NF1 was discovered in the late 1980s by Francis Collins, M.D., Ph.D. when he was a faculty member at the U-M Medical School, together with colleagues from other institutions. Collins is now director of the National Institutes of Health. That discovery paved the way for a genetic test that can now help definitively diagnose children with NF1, and guide their treatment.

Judith Sebolt Leopold, Ph.D., a research associate professor of radiology at the U-M Medical School, was a key member of the research team that developed PD0325901 while she worked at the Pfizer Research Laboratory formerly located in Ann Arbor.

The drug was first used in a cancer clinical trial in 2005, which was stopped when side effects on the retinas of some participants' eyes were noted. A new trial, using the drug in combination with another one, and comparing that combination with another drug combination, is now under way. Other MEK inhibitors, or MEKi drugs, are also in testing around the world, as scientists zero in on the RAS pathway as an important player in all kinds of cancer including melanoma.

In addition to Zhu, the research team includes U-M postdoctoral research fellow and former Zhu graduate student Yuan Wang, Ph.D.; Edward Kim, B.S.; former postdoctoral research fellow Xiaojing Wang, Ph.D.; and colleagues from other institutions Bennett G. Novitch, Kazuaki Yoshikawa and Long-Sheng Chang.

?The Texan Who Conquered Russia? Van Cliburn, who won the first Tchaikovsky Piano Competition at the height of the Cold War, has been diagnosed with advanced bone cancer.

?The 78-year-old piano legend is currently ?resting comfortably at his Texas home under excellent care, his spirits are high,? his long-time friend and publicist Mary Lou Falcone is quoted as saying.

The piano legend has played for international heads of states and for every American President since Harry Truman.

He started taking piano lessons from his mother at the age of 3. His debut with the Houston Symphony Orchestra took place when the prodigy was only 12-years-old. Cliburn studied at Juilliard, won the famed Leventritt Competition and performed with a number of orchestras across the country.

But a real breakthrough in his career came in 1958 when the 23-year-old pianist won one of the world?s most prestigious contests, the first International Tchaikovsky Competition in Moscow.

Since then he has sold out concerts, broke record sales and even prompted an Elvis Presley fan club to change its name to his.

Tired of years of stardom, in the late 1970s Cliburn took a sabbatical, feeling emotionally drained from endless touring. He moved from New York to Fort Worth, and has been living there ever since.

He began playing publicly again in the late 1980s. Until recently he practiced daily and performed limited engagements.

Cliburn won a Grammy Lifetime Achievement Award in 2004, and was presented with the Presidential Medal of Freedom in 2003.

The Crime Writers' Chronicle: Our Weirdest Jobs!

When mystery-world creators delve into their past, astounding things wriggle up from the gardens of memory! I invited some of our crime colleagues to share their adventures.

LARRY LIGHT: One summer in college, I worked in a chewing gum factory. My job was to manually lift cowpie-like hunks of semi-solid gum from a cart and put it into a hopper. Then it was split into long lines of gum so others manually cut it into plugs of the stuff for wrapping. I stank of sugar the entire summer. This was not a blessed state!

ALAFAIR BURKE: Between being a law professor, writing a book a year (ish), and hopefully being a dog walker again soon enough, I probably didn't need another job, but I went and found one anyway. One Saturday in June I spent a day as Guest Gelato Scooper for Mario Batali's Gelotto cart! Why would I want to scoop gelato, you ask? I frequently write at New York's Otto Pizzeria. I even have scenes from the Ellie Hatcher novels set there, starring Dennis the ( real ) bar manager. With the NEVER TELL book tour about to start, I knew I'd be away from New York for much of the summer and homesick. Spending a day in Washington Square Park, making people happy with gelato, seemed like a nice city memory!

KATE GALLISON: In high school I was baby-sitting for two kids when Grandma emerged from her bedroom and demanded that I lace up her corset.

JAMES SCOTT BELL: Being in charge of the fake food as a stagehand in a New York theater production of a Shaw play. It was my first paying theatrical gig since arriving in the city to become an actor. Even though I was backstage, I felt like had my foot in the door. The play had a big dinner scene, and after the curtain came down it was my job to rearrange all the fake food for the next night's performance. I felt a little like that guy who cleans up after the elephants at the circus. When asked why he didn't quit, he said, "What? And give up show business?"

J.T. ELLISON: My most unusual job was as a vet tech. You don't want to know what goes on behind the scenes at the vet! I lasted three days!

SHEILA YORK: When I was a sophomore in high school I was hired, along with some other girls, to pretend to be mannequins in a store window. We modelled fall fashions in August in Tennessee in a west-facing window without moving, with only one fan blowing on us from the narrow door into the store. (It could explain why I am to this day very unenthusiastic about shopping!)

CHRIS GRABENSTEIN: My first job ever! Selling sponges door to door. We were supposed to say that a portion of the proceeds went to help mentally handicapped children. The guy with the speech impediment was the top seller! I quit after two days!

KAYE BARLEY: After a divorce in my 20's, I was working as a secretary in Downtown Atlanta and not making much money. I decided I needed a part time job. A brand new Hilton Hotel had recently opened ? quite the place! Nikolai's Roof, The Casablanca Lounge, designer shops ? all quite upscale! With an international flair. I marched in, filled out a job application and was hired to work as a hostess in the Cafe de la Paix. My uniform looked like something out of the original Heidi movie ? plaid pinafore, ruffled petticoat under a very short skirt. (and this was a French restaurant ? what was with the plaid? Horrible!) One evening, when the gal who was supposed to take care of the "take out" window didn't show, I was put in her place. I want to tell you ? the things some guys traveling on business have the nerve to say to a young twenty-something-year-old waitress are beyond the pale! I'm going to blame it on the drinks in the Casablanca Lounge! I didn't last through the evening! I have no idea who continued selling pastries through that take out window that evening, but it wasn't me! Not only was it very weird, it was very short!

CAMILLE MINICHINO: One of my first (signings) was at a local market. The manager, whom I knew, had always wanted to open a bookstore! Stuck with a deli/market, she was determined to at least host a book party, and it was very successful. She had coffee from a small shop next door, made cookies, stencilled guns on a bedsheet the color of my book cover and used it to cover the meat cases!


ANNETTE MEYERS: In the late 50's I was teaching high school English in New Jersey and living in the city. I had a boyfriend who worked for a car rental agency, ferrying cars out to La Guardia for the rental booth there and picking up others and driving them back into the city. Sometimes they were short of help, and they'd call on me and I filled in. I didn't know Queens and I was used to driving a VW. I just followed one of the workers out to the airport the first time in a big car, and then went back and forth all that summer. I stopped seeing the guy by the end of the summer!!

SUNNY FRAZIER: As a confidential secretary with an undercover narcotics unit. They stuck me out in a double-wide trailer in a nectarine orchard with 10 alpha males! No real supervision as we were so far away from headquarters. Every day was full of hijinks and I had to sometimes treat the men like they were kindergarteners. They were proud of me and used to say, "Only one member on the team is a military vet and college graduate ? and that's our secretary!" I spent eleven years with them, the longest any woman has ever lasted! It gave me lots of great material for my Christy Bristol Astrology mystery novels. I don't ever have to come up with plots ? I lived them!

DENNIS PALUMBO: Trying to break into show business as a writer, way back in my early 20's. While I was writing spec TV scripts, I earned extra money selling jokes to stand-up comics. I would hang around the Comedy Store on Sunset Boulevard, pitching jokes to stand-ups after the acts were finished. Tough gig, let me tell you! One time I was trying to sell some one-liners to an older Vegas comic, and he asked me to meet him in his gym's steam room. So there I was, surrounded by old guys in towels, all sweating our brains out, and I'm trying to read jokes to him from a sheet of paper. Meanwhile, the steam is making the ink run on the paper? Next time, I'm on the road with Gabe Kaplan, at that time the star of Welcome Back, Kotter, and I'm writing jokes for his act. Our deal was, I got paid for every joke that got a laugh. So, we're in the New York City Playboy Club lounge, at 4 A.M. and he's just done a set, which included some of my new jokes. So we sit in the back, arguing about each joke in terms of whether it got a laugh or a chuckle. If it got a laugh, he paid me. If a chuckle, no. Our debate lasted half an hour, ending with us canvassing the few patrons sober enough to speak coherently, asking if they thought a particular joke was funny! Soon afterwards, I was employed as a writer, then screenwriter, and didn't have to peddle jokes to comics anymore. Now long retired from show biz, I'm a licensed psychotherapist, and mystery author! Still, I have fond memories of that early time!!! DOUG LYLE: If ever I had any doubts about going to college, and I never did, those would have evaporated on a very hot July day in Huntsville, Alabama. I had a summer job at a lumber yard, a good way to make some money and get in shape for the next football season. Loading dry wall all day will do that.But on this day, a very strong black guy I worked with called Mr. Golden and I were dispatched in a flat bed truck to unload roofing tiles from a box car over at the rail yards. Forty pallets on those old asphalt tiles. No problem! We had a fork lift on the truck and it was a simple matter of lifting the pallets, removing them from the box car, and settling them in the long bed of the truck. Piece of cake! Not so fast? The box car had a sliding door that ran on metal rails at its top and bottom. The bottom rail prevented the fork lift from entering the car - it was slung too low. So we had to do it by hand. Each pallet had ten squares, each square three bundles, and each bundle weighed 67 pounds! So we had 1200 bundles to off load. Did I mention it was July? The outside temperature was 95, the humidity the same, and inside the box car it was 140 if it was anything! We took turns being in the car. Lifting a bundle and tossing it out the door, where the other guy would catch it and stack it on an empty pallet. Took us five hours! No food, no water, we were way out on the far reaches of the rail yard. Took two days to recover from this little adventure. Never again!!!!

LOIS WINSTON: My weirdest job wasn't at all weird back in the day, but by today's standards??? If I said I once had a job spec'ing type, I doubt many people now would know what I was talking about. Typesetters have gone the way of the dinosaurs. Everything from magazine ads to book text to the words on a bag of Cheetos is done in no time with a few computer keystrokes. However, back before computers, figuring out how big to make the font to fit within a text block was tedious work that involved (shudder) math. And being a totally right-brained person, math and I didn't exactly get along. Make an error, and it cost in both dollars and time, not a good thing when each job was on a tight budget and an even tighter deadline. Great for inducing panic attacks, though getting fired was a huge relief!

THELMA STRAW: Ever wonder what nuns wear under those voluminous robes? For sure, not Victoria's Secret! One fall, while enrolled in one of the colleges in Oxford, England, I ran out of money to pay my room and board at the hostel run by the Anglican nuns there. They graciously offered me a trade - doing their laundry for lodging. In an open shed in the middle of their huge cabbage garden, daily I stirred over an open fire a huge cauldron filled with a weird assortment of bloomers, female tops, long black cotton stockings and some sort of Elizabethan petticoats (from a Mother Goose fairy tale) in a steamy brew of the nuns' homemade soap. Not Ivory! I then hung them on a line over the rows of cabbages, often wondering if I got the garments really clean! The icing on the cake was that at mealtime the ladies served their boarders cabbage ? thrice per diem! Cabbage mush, cabbage cereal, cabbage bread, cabbage pudding! Nowadays I rarely meet a cabbage dish I'll eat!

New wave of technologies possible after ground-breaking analysis tool for nanometer devices developed

ScienceDaily (Aug. 26, 2012) ? The nuclear magnetic resonance apparatus -- developed by the University's Department of Physics and Astronomy -- will allow for further developments and new applications for nanotechnology which is increasingly used in harvesting solar energy, computing, communication developments and also in the medical field.

Scientists can now analyse nanostructures at an unprecedented level of detail without destroying the materials in the process, a limitation researchers across the world faced before the Sheffield experts' breakthrough.

Dr Alexander Tartakovskii, who led a team of researchers, said: "We have developed a new important tool for microscopy analysis of nanostructures. In the very tiny quantities of matter used in nanostructures the behaviour of electrons and photons is governed by new quantum effects, quite different from what happens in bulk materials. This makes them attractive for various new technologies.

"Development requires careful structural analysis, in order to understand how the nanostructures are formed, and how we can build them to enhance and control their useful properties. Existing structural analysis methods, key for the research and development of new materials, are invasive: a nanostructure would be irreversibly destroyed in the process of the experiment, and, as a result, the important link between the structural and electronic or photonic properties would usually be lost. This limitation is now overcome by our new techniques, which rely on inherently non-invasive nuclear magnetic resonance (NMR) probing."

The results open a new way of nano-engineering, a full characterisation of a new material and new semiconductor nano-device without destroying them meaning more research and development and device fabrication processes.

Dr Tarakovskii added: "We have developed new techniques which allowed unprecedented sensitivity and enhancement of the NMR signal in nanostructures. Particular nanostructures of interest in our research are semiconductor quantum dots, which are researched widely for their promising photonic applications, and potential for the use in a new type of computer hardware employing quantum logic.

"The result of our experiments was quite unexpected and changed our understanding of the architecture of these nanomaterials: we learned new information about the chemical composition of quantum dots, and also how atom alignment inside the dots deviates from that of a perfect crystal. Importantly, many more measurements of optical and magnetic properties can be done on the same quantum dots which have undergone the NMR probing."

The development of the new techniques and all experimental work was carried out by Dr Evgeny Chekhovich in the group of Dr Alexander Tartakovskii at the Department of Physics and Astronomy in Sheffield. Quantum dot samples used in this work have also been fabricated in Sheffield, in the EPSRC National Facility for III-V Semiconductor Technology.

We must work on our self-esteem, to learn exactly what is keeping us from either giving love or accepting love. Please note that if one of you is perfectly fine with who they are, the other one will have SO MUCH EASIER TIME accepting your relationship even if they hadn?t worked on their issues yet. This happens, because a person who is happy within themselves will never have to retort. To fast track your own healing, it would be a great idea to seek counselling from a relationship life coach or a psychologist. These are very practical solutions to what seems to be a mysterious problem but really isn?t. Remember that all-consuming love is not the privilege of only those who hold new age beliefs. There is also nothing telling that you shouldn?t seek couple?s therapy if you are struggling to hold onto each other.

For the cheap, ;) the DYI folk and those who like things mysterious, you need to be very courageous in looking into your own psyche and finding out your own issues for yourself. I would highly recommend you contacting your soul and ask help in clearing out your internal drama. WASHINGTON PARK, Ill. (AP) ? An Illinois police chief says a Missouri teen who was held captive in a house for more than three years went there voluntarily but was not allowed to leave when she wanted to go home.

Washington Park Police Chief David Clark said Friday that the 19-year-old woman bolted from the home on Monday. Police arrested the man she accused of holding her captive and his mother Thursday in a raid on the house. They also rescued the teen's 2-year-old son.

No charges had been filed as of Friday.

Police in St. Louis listed the teen as a missing or runaway juvenile in April 2009.

The teenager told police her captor routinely beat and sexually assaulted her, resulting in her son.

Clark says the teenager met her alleged captor socially.

Neil Armstrong, the quiet and self-described nerdy engineer who commanded the Apollo 11 spacecraft that landed on the moon July 20, 1969, has died. He was 82. Armstrong died following complications resulting from cardiovascular procedures, his family said.

His first words after setting foot on the surface are etched in history books and the memories of those who heard them in a live broadcast.

"That's one small step for man, one giant leap for mankind," Armstrong said.

1.) Subject is the Spine

If PowerPoint and similar charting and presentation software is a bit rich for your budget, you may find the free, open-source office suite, Open Office fits your bill perfectly.

Google Is Not Happy With This Proposed Law | WebProNews

Google has been speaking out about a proposed law in Germany, which would require search engines and aggregators to pay to license content from publishers via ancillary copyright, in order to display headlines (with links) and snippets of text. You know, the typical display of search results you see in Google News. It does seem to be specific to the Google News format, which takes the beginning of the article (usually not much more than a sentence or two), as opposed to the web search format, which provides more random snippets of text, based on the user?s query. Of course, the law is still being drafted, so who knows?

Back in March, the German Ministry of Justice was tasked with penning the law, which in the meantime has gone through multiple drafts. It?s currently said to be on number three.

A Google spokesperson tells WebProNews, ?We don?t have any sympathy for these plans, as an ancillary copyright lacks all factual, economic, and legal foundation. And we are not alone with this opinion: The Federation of German Industries (BDI) and 28 other associations vehemently oppose an ancillary copyright for publishers. The German parliament is divided on the issue as well. For a good reason: An ancillary copyright would mean a massive damage to the German economy. It?s a threat to the freedom of information. And it would leave Germany behind internationally as a place for business.?

?Publishers should be innovative in order to be successful,? the Googler adds. ?A compulsory levy for commercial internet users means cross-subsidizing publishers through other industries. This is not a sustainable solution.?

?In difficult economic times, the Internet is thriving, generating economic gains, creating jobs and giving struggling businesses a vital lifeline,? the spokesperson says. ?It is important that any legislation supports, rather than hinders innovation on the internet to encourage new jobs and economic growth.?

Google?s Kay Oberbeck, out of Hamburg, addressed it in a Google+ post (in German) earlier this week. In that, he said (according to Google Translate?s translation):

A law to the detriment of all , the Internet is an interdisciplinary technology our economy, BITKOM already eleven percent of German jobs from the Internet are dependent, ie some four million jobs. Here lives the power of billions of people and companies that connect with each other, share their knowledge and information. In other words, this law could do a good deal of harm to Germany?s economy, which largely depends on the Internet, and the sharing of information. This law would hinder that sharing of information, potentially reaching beyond search engines like Google, but possibly to bloggers and Internet users in general.

GigaOm?s David Meyer got some additional commentary out of him (in English), quoting him as saying, ?Nobody sees a real reason why this should be implemented. It?s really harmful, not just for users who wouldn?t find as much information as they find now, but such a law is also not justified for economic reasons or judicial reasons.?

Joe McNamee, advocacy coordinator at European Digital Rights (EDRi), tells WebProNews, ?The draft proposal for ancillary copyright provisions aims at regulating (direct and indirect) commercial use of press products. Under the draft law, publishers would be able to prohibit further use of their products. Services, such as Google, who publish even very small parts of published contents would have to obtain a licence and pay a tax in order to do so. Publishers have been pushing for extensive rights to regulate what is indexed by search engines, arguing that existing HTML is not enough.?

?The justification for the legislative proposal in Germany is therefore that services, such as Google re-publish (or ?steal?) snippets of content and benefit from journalistic work ? hence publishers deserve a share of Google?s profits,? McNamee adds. ?Fact is, however, that things are not all quite as bad as publishers sometimes describe them. For example, Germany?s biggest publisher Axel Springer announced an increase of 55% for its online products in the first half of 2012.?

It?s a pretty classic storyline, really. Media giants want to get paid because search engines and aggregators are getting benefit from their content. The concept of ?fair use? always comes into play, as does the nature of the web in general, which is built upon content linking to other content. Search engines aren?t publishing full text content. They?re providing links with small snippets, and sending traffic on to the source, for those who want to read the content.

?The fact that these snippets drive large amounts of traffic to the publishers? websites, to their benefit is neatly ignored,? says McNamee. ?The logic is broadly similar to Disney demanding to be compensated by airlines for advertising flights to Florida using pictures of Disneyland.?

Google even offers a variety of options to publishers who offer paid content, or content behind other walls. And of course, there?s always the good ol? robots.txt.

Google has dealt with similar mentality from media giants like News Corp. and the Associated Press in the past. Google actually did license AP content to be able to host it.

But in this case, we?re talking about an actual law, and Google is probably not willing to enter into such agreements with every publisher in its results. What would Google?s plan of action be should the law take effect? Perhaps Google could simply not include content from publishers who required compensation, and let those who are simply happy with the traffic opportunities sign up for inclusion for free. You can already submit your site to Google News as it is, and it?s not as though there will be a shortage of content. It would be interesting to see if those seeking fees would miss the traffic, and ultimately submit.

Of course, there is always the possibility that Google would index other sites and blogs who are still linking to other publishers as the original sources, which would likely lead to more legal targeting of blogs by said publishers on similar grounds (if the law doesn?t already lead to that to begin with).

Step outside of the search engine mindset for a moment and just think about your own blogging habits. Let?s say you found some point in this article interesting, and wanted to discuss it in a post on your blog. Maybe you wanted to quote something I said, and even include a link. Under such a law, perhaps we, the publisher, may not like that you?re using our content, and decide to make a legal case out of it. Of course, we wouldn?t do that, as we encourage links and the sharing of information.

The point is that this is how the web works, and any law aiming to prevent that, can?t be good for the web as we know it.

You can also think about how social media sharing works. You know what happens when you share a link on Facebook? It displays the link a snippet of text ? pretty much in exactly the same fashion Google does.

Does that mean Facebook would be required to pay publishers too, even though it?s users sharing the links? Does it make users liable? You can see what a legal mess this could be.

?Ancillary copyright provisions could potentially become a tool for publishers to put bloggers under pressure and ultimately stifle free speech,? says McNamee. ?Bloggers or users of social media publishing snippets generally don?t have the financial power to defend themselves in court. The first draft of the law would have created legal uncertainty.?

?However, after harsh criticism from civil society groups, the draft law was amended to explicitly exclude bloggers who use ads or micro-payment systems on their sites,? he notes. ?Still, the current draft would restrict the diversity of information on the internet. Due to the vague definition of a ?press product?, search engines would need to conclude thousands of individual contracts. Smaller publishers and bloggers do not have the capacity to do the same. So this is likely to result in a creation of exceptions for monopolies, leading to an uncompetitive market situation. Ultimately, this will also limit the freedom of communication and freedom to do business.?

?Even though Google, understandably is campaigning against the proposal due to the wider precedent that it would set, as an isolated case, it would be quite beneficial to them,? he says. ?The bureaucratic, administrative and financial costs in respecting such a law would be a significant barrier to market entry, helping Google maintain its market share.?

Meyer points to an earlier version of the law, which even went so far as to indicate that employers would have to pay publishers for letting employees read the news online at work. It does appear that the law is aiming more towards search engines now, as Meyer notes that a second draft narrowed the scope of the legislation in this way, but then the whole thing just seems like a double standard.

Where is the line between a search engine and an aggregator? An aggregator and a blog or social media account? The lines aren?t that clear, because people and companies use different platforms in different ways. Besides, according to Meyer, the publishers aren?t even happy with the second draft, and liked the first draft better.

Rumor has it that the third draft of the law has been finalized, and is going to be negotiated in the Chancellor?s cabinet end of August, according to McNamee.

The whole thing is absurd, for a variety of reasons, he says. ?It is absurd because the proposal, which would, as I said, benefit Google, was proposed, at least in part, due to anti-Google feeling among certain German politicians. It is absurd because the proposal seeks to ?compensate? publishers for something that is actually beneficial to them. It is absurd, because European copyright law is on its knees due to the excessive compliance costs and bureaucracy ? and the publishers are asking for more costs and more bureaucracy and claim to support copyright enforcement.?
